“The last word has not yet been spoken”

The facts are clear: Alex Schwazer must have reached the Olympic limit for the 31-kilometer competition by May 50st in order to maintain his chance of taking part in his flagship discipline in Tokyo. The deadline for the 20-kilometer competition is June 29th. In order for the walker from Kalch to be able to take part in a race and even reach the required limit, his ban must be lifted. The Schwazer team's hopes are high at the Swiss Federal Court , which is the only body that can overturn the rulings of the International Court of Arbitration for Sport (and thus the Schwazer ban until 2024). But the Swiss Supreme Court is taking its time. “We have requested an emergency order from the Federal Court so that the ban can be lifted. But no decision has been made yet,” said Gerhard Brandstätter, Schwazer’s lawyer. The Swiss Federal Court has now asked the opposing parties, i.e. WADA (World Anti-Doping Agency) and WA (World Athletics Association), to once again justify why the ban is being persisted. Hope for a provisional injunction The Federal Court gave WADA and WA until June 7 to file these pleadings. In order to meet the Olympic limit for the 50 kilometers, Schwazer would have to compete in a competition within May. So has the Olympic dream shattered? “The last word has not yet been spoken,” said Brandstätter, who hopes that the Federal Court will issue the provisional order to lift the ban – as requested by the Schwazer team. The process would then continue, but the walker could at least now start racing. Brandstätter hopes that he will receive an answer from Lausanne in the next few days. Because one thing is certain: Schwazer is slowly but surely running out of time.
