CAS ruling: IOC is considering going to the Swiss Federal Court

Lausanne (SID) The International Olympic Committee (IOC) may want to challenge the ruling of the International Court of Arbitration for Sports (CAS) in the Russia cases and is considering going to the Swiss Federal Court. At the same time, the IOC made it clear once again that the 28 Russian athletes exonerated by CAS would not automatically be allowed to take part in the Winter Olympics in Pyeongchang (February 9th to 25th). “The result of the CAS decision does not mean that the group of 28 athletes will now be invited to the Games,” the IOC said. The IOC's decision of December 5th stands and makes it clear that "since the suspension of the Russian Olympic Committee ROC, its athletes can only start in Pyeongchang with an invitation from the IOC." If the IOC remains consistent, it will not send these invitations to the Russian athletes. The athletes could then take legal action against it. The IOC welcomed the fact that the CAS had only partially confirmed the objections in eleven cases, thereby confirming systematic doping in Russia. In the cases of the 28 acquitted athletes, the CAS unfortunately did not take into account the evidence of systematic manipulation. The IOC placed particular emphasis on the fact that the CAS Secretary General himself had emphasized "that the CAS decision 'does not mean that these 28 athletes have been declared innocent'." The IOC banned 43 Russian athletes for life from the Olympics for violating anti-doping guidelines at the 2014 Sochi Winter Olympics. 42 of them appealed and went to the CAS. The Court overturned the bans in 28 cases, and in eleven other cases the athletes' objections were partially confirmed. Three cases are still being treated. The Swiss Federal Court is considered the final authority in sports arbitration and usually only intervenes in the event of administrative errors.
