Doping offenders Hauke and Baldauf apologize

The defense wanted to get the sentence reduced after the Supreme Court (OGH) overturned two charges. It was about two races that the former ÖSV athletes ran in Germany and Finland. There are different legal frameworks for doping than in Austria. The prosecutor admitted that the charges in question would now be eliminated. Nevertheless, the jury did not change the sentences because, in their opinion, they were “too lenient” at the first hearing, the judge stated in the reasons for the judgment. Both the defense attorney and the public prosecutor filed a waiver of appeal, meaning the verdicts were legally binding. Hauke and Baldauf made a “remorseful and complete” confession during the negotiations. "I plead guilty. I am extremely sorry,” said Hauke and apologized to “Sportland Austria”, the ÖSV, its competitors, sponsors and those affected. His defense attorney said in advance that a reduction in the sentence would be important because it would then no longer appear in the criminal record. The Styrian was “extremely stressed” by the length of the proceedings and it was “getting to his nerves”. Baldauf also apologized, including to the young athletes. “I stand for what I did right now,” he said. He and Hauke only realized afterwards that they had “put obstacles in the way” of the young athletes. After the doping scandal, it was not clear how cross-country skiing would continue. In the case of Hauke, the public prosecutor said that the two most important mitigating factors - a confession and Hauke's integrity - were present. Therefore, the punishment could be set in the “lower range”. However, from the judge's point of view, diversion, as suggested by the defense, was out of the question "due to the seriousness of the crime". The judge cited the same reasons for sentencing for Hauke and Baldauf. The Senate assessed in mitigation the positive lifestyle, the consequences for the defendants such as the loss of their job or their contributions to finding the truth. In the case of Hauke, the judge also brought into the meeting the video of the raid, which shows him doping. “The video of the incident was out in the world,” he noted. What made things more difficult, however, was the length of the crime period and the fact that there were several injured parties. Baldauf was sentenced in Innsbruck in January 2020 and Hauke in October 2019. Both had admitted to taking growth hormones and to blood doping. The two former cross-country skiers were caught by the authorities as part of Operation Aderlass at the Nordic World Ski Championships in Seefeld in February 2019. German and Austrian authorities uncovered an international doping ring involving the German sports doctor Mark S. during raids in Erfurt and Tyrol.
